Доводим до вашего сведения, что новосибирский современный художник, студент, видеооператор, организатор различных выставок и кинофестивалей (в том числе фестиваля «Киноварь», посвящённого Новосибирску) Артём Александрович Лоскутов находится под стражей. Его несправедливо обвиняют в хранении наркотиков и создании «преступной группы», в которую волею служащих Центра противодействия экстремизму при ГУВД по Новосибирской области оказались «включены» граждане, замеченные всего лишь (!) в телефонных переговорах с Артёмом.
15 мая Артём был задержан сотрудниками милиции в ответ на нежелание немедленно приехать в Центр противодействия экстремизму, также известный как Центр «Э». Его приглашали на «беседу» (приглашение по телефону озвучил начальник этой организации утром того же дня). Артём отказался «беседовать», сославшись на занятость по месту работы, после чего абонент озвучил ряд угроз в адрес Лоскутова, в том числе приехать к нему на работу в этот же день (а точнее, «прислать машину с собакой»).
Вечером того же дня, во время задержания, Лоскутову была подкинута марихуана (в количестве 11 граммов). О факте подброса красноречиво свидетельствуют показания свидетельницы, а также многочисленные нарушения процедуры личного досмотра и задержания. Косвенно об этом свидетельствует довод, что ни один человек в здравом уме, коим, несомненно, обладает Лоскутов, не стал бы носить с собой марихуану в свете обещанного визита силовиков, даже если бы она у него имелась. Неявка на «беседу» не является ни преступлением, ни актом неповиновения (термин «беседа» в законодательстве отсутствует). Однако, о последовавшем в этот день аресте Вам уже известно. Не слишком ли тяжёлая и не слишком ли незаконная кара в ответ на нежелание «побеседовать»? Между тем, настоящей причиной ареста, с большой вероятностью, является активная общественная деятельность молодого художника.
Итог: Дзержинский суд, принимая решение о предварительной мере пресечения, не принял во внимание положительные характеристики Артёма; многочисленные дипломы и награды, полученные за культурные и академические достижения; представленные личные поручительства; факты, что он работает и учится. А также того, что ввиду подготовки студенческого диплома по месту учёбы (НГТУ), и значительной загруженности по месту работы Артём едва ли станет скрываться от следствия. Судья Елена Девятайкина оставила Лоскутова под стражей. С учетом всех приведённых фактов это является неоправданно жёсткой мерой.
Под угрозой оказались подготовка и защита студенческого диплома, а также благополучное окончание ВУЗа, не говоря уже об испорченной репутации и перспективе получить уголовное наказание за преступления, которых Артём не совершал.
Артём известен как положительный человек, талантливый художник, создатель кинофестиваля о Новосибирске и просто активный деятель культуры. Мы выражаем свой протест против бесчеловечного процесса, жертвой которого стал Артём, а также против незаконных действий сотрудников Центра противодействия экстремизму. Мы считаем, что уголовное дело против Артёма сфабриковано (дело № 901380). Обращаем Ваше внимание на то, что сложившаяся ситуация создаёт опасный прецедент, могущий серьёзно подорвать гражданские свободы в городе Новосибирске и за его пределами, этот прецедент ставит под удар каждого гражданина. Прискорбно, что подобное событие случилось именно в Год Молодёжи.
Есть все основание полагать, что дело А.А. Лоскутова имеет политический характер, и находится в широком ряду других, менее известных дел, ведение которых сопровождается систематическим нарушением прав человека и законодательства РФ.
Грубые нарушения в работе государственных органов систематически имеют место именно в делах, связанных с выражением мирного протеста или недовольства работой государственных органов, что позволяет говорить о политических репрессиях, в настоящий момент имеющих место в России.
В связи с этим мы требуем следующего:
Все судебные процессы должны быть открытыми. (На слушание дела Лоскутова под предлогом отсутствия мест были допущены только журналисты.)
В суде должны быть озвучены все материалы, на основе которых строится обвинение. (Главным основанием определения меры пресечения в виде заключения под стражу стали не озвученные в судьей материалы Центра по противодействию экстремизму.)
Проведения масштабной проверка на предмет превышения полномочий Центра по противодействию экстремизму (А. Лоскутов был задержан сотрудниками Центра по противодействию экстремизму капитаном милиции Лазаревым А.В. и лейтенантом милиции Борникова А.В. Однако в заявлении СМИ В. Пешнев, руководитель Центра по противодействию экстремизму, указал, что «задержание было произведено в рамках обычного рейда по противодействию незаконному обороту наркотиков».)

Artem Loskutov is a Novosibirsk contemporary artist, university student, video cameraman, and curator of various exhibitions and film festivals. Artem is now in police custody awaiting trial on charges of narcotics possession and organization of a “criminal group.”
On the morning of May 15, 2009, the head of the Novosibirsk branch of the Interior Ministry’s Center for Extremism Prevention (Center “E”) telephoned Artem and ordered him to come to their offices for a “conversation.” Artem turned down this invitation, explaining that he had to go to work. This law enforcement official then began threatening him. He promised to show up at Artem’s workplace that very day. (To be precise, he threatened to “dispatch a squad car with a dog.”)
That evening, Artem was detained on the street by plainclothes Center “E” officers, who allegedly found eleven grams of marijuana in his bag. It is our contention that the arresting officers planted the marijuana themselves. Loskutov’s girlfriend, Lyubov Belyatskaya, who witnessed his arrest, has testified to this effect; the numerous procedural violations committed by the arresting officers as they detained Artem and searched his person and belongings likewise point to this fact. It also stands to reason that no one in his right mind would carry marijuana on his person the very same day that law enforcement officials had promised to pay him a visit.
Failing to report for a “conversation” is neither a crime nor an act of insubordination: the term “conversation” does not figure in the Russian legal code. However, Artem was arrested on the very same day that he refused to report for a “conversation.” Isn’t this much too severe a punishment for his unwillingness to cooperate with the police’s unlawful request? Could this be an act of illegal retaliation on their part?
It is more than likely that the real reason Artem was arrested was his public art activism, including his role in organizing the annual May Day “Monstrations” in Novosibirsk, during which young people march with absurdist, non-political slogans. This year, under pressure from the police and after the city refused to grant a permit for the Monstration, Artem publicly declared that he would not be participating. The Monstration went ahead without him.
During Artem’s preliminary custody hearing, Center “E” officials revealed that they had been wiretapping his phone for the past six months. They have identified as members of Artem’s alleged “criminal group” people whose only crime is that they are known to have talked with him on the phone.
During this same hearing, the Dzerzhinsky District Court ignored all evidence that testified to Artem’s good character and trustworthiness: numerous academic and cultural awards; personal guarantees offered by a number of respected individuals; the fact that he is gainfully employed and busy preparing his diploma thesis defense (at Novosibirsk State Technical University). He is thus an unlikely flight risk. Despite all this evidence, Judge Elena Devyataikina remanded Artem to custody. This was a needlessly harsh ruling.
Artem stands to pay a high price for the police’s retaliatory campaign against him. It is not only his ability to defend his thesis project and thus successfully graduate from university that is under threat. He also faces the prospect of a tainted reputation and criminal punishment for crimes he did not commit.
In reality, Artem is a positive human being, a talented artist, and an outstanding cultural activist, as witnessed by his creation of the Kinovar Festival, a showcase for films about his hometown of Novosibirsk.
We protest the inhumane actions of the court against Artem, as well as the illegal actions undertaken by the Center for Extremism Prevention. We contend that the case against Artem (Case No. 901380) has been fabricated. We believe that this case sets a dangerous precedent for the exercise and protection of civil liberties in Novosibirsk and the country at large. This precedent threatens the safety and freedom of every Russian citizen. It is especially regrettable that this incident is taking place during the officially declared Year of Youth in Russia.
We have every reason to believe that, like a number of other, less well-known cases, Artem’s case is political in nature. In their prosecution of these cases, the authorities routinely and systematically violate the civil rights of arrestees and defendants, as well as the laws of the Russian Federation.
State authorities commit such gross legal violations precisely in cases involving peaceful protest and the public expression of dissatisfaction or dissent with the actions or policies of the authorities. We are thus forced to conclude that a wave of political repression has been unleased against social and political activists, artists, and ordinary citizens in Russia.
Our demands:
All court proceedings and hearings should be open to the public. (Only journalists were admitted to the courtroom during Loskutov’s preliminary custody hearing.)
The court should make available to the defense, to the press, and to the public all evidence relevant to the prosecution’s charges against Loskutov. (The judge’s decision, on May 20, to remand him to police custody pending trial was based on secret information provided by the Center for Extremism Prevention.)
A commission should be convened to determine whether the Center for Extremism Prevention has abused its powers and exceed its remit. (Loskutov was arrested by officers of the Center. However, in a statement to the press, Center head Vyacheslav Peshnev claimed that “the arrest was carried out as part of an ordinary drug trafficking raid.”)

Die Unterschriftensammlung zum Schutz Artjom Loskutov
Hiermit machen wir alle darauf aufmerksam, das ein moderner Künstler, Student, Videooperator und Veranstalter verschiedener Ausstellungen und Filmfestivalen Artjom Loskutov in Novosibirsk inhaftiert wurde.
Willkürlich wird ihm Drogenbesitz und Bildung einer “Extremistischen Gruppierung” vorgeworfen. Willens des Zentrum für Extremismusbekämpfung des Landkreispolizeipräsidiums Novosibirsk wird die Mitgliedschaft in dieser Gruppe Menschen vorgeworfen die sich durch Telefonkontakt mit Artjom bemerkbar gemacht haben.
Am 15 Main wurde Artjom von der Polizei Festgenommen. Dies geschah als er es verweigerte sofort in den Zentrum für Extremismusbekämpfung «zu einem Gespräch” mitzufahren. Früher an diesem Tag verweigerte Artjom diese Einladung per Telefon, als er vom Chef des Zentrums “E” morgens Angerufen wurde. Darauf folgten Drohungen ihn mit “Auto mit Hund” von der Arbeit abzuholen.
Abends, bei der Festnahme, wurde dem Herrn Loskutov 11 Gramm Marihuana zugesteckt. Dies wird glaubwürdig durch Aussage der Zeugin und mehrfache Rechtsverstöße seitens der Polizei bei seiner Durchsuchung und Festnahme bestätigt. Die Fragwürdigkeit bestätigt auch die Tatsache, dass Artjom von seiner Festnahme wusste und deswegen kaum auf die Idee kommen könnte Marihuana mitzuführen, selbst wenn er die besitzt hätte.
Ein Nichterscheinen zum “Gespräch” ist weder ein Verbrechen, hoch ein Akt der Ungehorsamkeit (das Fachbegriff “Gespräch” ist in der Gesetzgebung nicht präsent). Dennoch, wie Sie wissen, war Artjom Loskutov schon abends unter Arrest. Ist es nicht eine zu ungerechte Strafe für die nicht vorhandene Lust zu einem “Gespräch”? Der wahre Grund für die Festnahme ist offensichtlich die aktive Bürgerrechtseinstellung des jungen Künstlers.
Fazit: Dzerzhinskij Bezirksgericht wurde von Artjoms positiven Charakteristiken; vielfache Auszeichnungen und Ehrendiplome für seine Akademische und Kulturelle Errungenschaften; mehrere persönliche Bürgschaften sowie die Tatsachen, dass er Arbeitet und Studiert. Da Artjom gerade professionell sehr beschäftigt ist seine Diplomarbeit abschließt ist es Äuserst unwahrscheinlich das er vom Gesetz flüchten wird. Dennoch verlängert Richterin Elena Dewjatkina die Inhaftierung des Herrn Loskutov. In Hinsicht auf dargelegte Fakten ist es eine Unzumutbar brutale Maßnahme.
Abgesehen vom geschädigtem Ruf und der Perspektive willkürlich Verurteilt zu werden, stehen die Vorbereitung und Verteidigung der Diplomarbeit, sowie Artjoms erfolgreicher Studiumabfluss auf dem Spiel.
Artjom Loskutov ist als ein positiver Mensch, talentierter Maler, Veranstalter des Filmfestivals über Novosibirsk und kulturell aktiver Bürger bekannt.
Wir Äußern hiermit unseren Protest gegen diesen entwürdigenden Prozess, dessen Opfer Artjom wurde, sowie gegen verfassungswidrige Aktionen der Mitarbeiter des Zentrums für Extremismusbekämpfung. Wir behaupten das die Beweismittel, sowie Akten für seine Strafverfolgung fabriziert wurden (AZ № 901380) Wir machen Sie darauf Aufmerksam, dass dies ein gefährlicher Präzedenzfall sein kann, der sich negativ auf die Bürgerfreiheit in Novosibirsk und Russland auswirken wird. Dieser Fall stellt die Rechte von allen in Frage. Eine bittere Tatsache, das dies in der “Stadt der Jugend” passiert.
Leider gibt es allerlei gründe zu vermuten, dass der Prozess gegen A.Loskutov einen politischen Hintergrund hat und zu einer Reihe von anderen, weniger bekannter Prozesse gehört, bei denen systematisch Menschenreche, sowie Gesetze der Russischen Föderation verletzt werden.
Diese mutmaßliche und systematische Gesetzesverstoße werden besonders bei der Verfolgung von friedlich Protestierenden, sowie andersdenkenden und Regierungkritischen Meinungträgern praktiziert. Dies zeugt von einer organisierter politischer Repression seitens der Russischen Regierung.
Deswegen fordern wir:
Alle Gerichtsprozesse müssen öffentlich stattfinden ( des Platzmangels wegen durften im Falle von Herrn Loskutov nur Journalisten zuschauen)
Alle belastende Beweismitteln sollen im Gerichtssaal vorgetragen werden (die Inhaftierung von A.Loskutov wurde aufgrund von nicht erwähnten Beweisen des Zentrums für Extremismusbekämpfung beschlossen).
Eine umfassende Ermittlung gegen Dienstverstoße des Zentrums für Extremismusbekämpfung (Die Festnahme des Herrn Loskutov wurde von den Beamten des Zentrums "E" durchgeführt. Die offizielle Stellungnahme besagt jedoch, das dies ein Teil einer Drogenbekämpfungsmassnahme gewesen ist).

Artem Loskoutov, artiste contemporain, vidéaste et organisateur des expositions et des festivals de cinéma à Novossibirsk, est en détention. Selon la version du Centre d’action contre le terrorisme, il est accusé d'avoir conservé des drogues et d’avoir créé un “groupe criminel” dont font partie toutes les personnes ayant parlé au téléphone (!) avec Artem.
Le 15 mai 2009, Artem a été arrêté par les représentants de la police à la suite de son refus d’aller au Centre d’action contre l’extrémisme. Il avait été invité pour “une conversation” par le chef du centre le matin même. Artem a refusé de se rendre à cette convocation inofficielle. Il a été menacé par son interlocuteur, qui a avancé la menace de venir le chercher directement sur son lieu de travail (d'après le texte, d’“envoyer une voiture et un chien”).
Le soir du 15 mai, alors qu’il était déjà arrêté, les représentants de la police ont introduit du cannabis (11 gr) dans le sac d’Artem. Un témoin atteste que les policiers ont effectivement mis le cannabis dans ses affaires, mais qu’ils ont également commis de nombreuses violations de la procédure légale lors de la fouille. Dans la mesure où cette proposition de “conversation” n’était pas officielle, le refus de s’y rendre ne constitue pas en tant que tel un délit. L’arrestation d’Artem Loskoutov, en plus d’être marquée par les entorses à la procédure, est de surcroît illégale et fabriquée. Lors de son passage devant la cour le 20 mai 2009, il a été inculpé officiellement pour son activité publique et pour son “appartenance à un groupe organisé”.
Des violations de la législation sont nombreuses : le 1 mai 2009, Artem avait déjà eu une conversation avec Sergueï Miller, le chef du centre. Ce rendez-vous a duré plusieurs heures, pour autant le Centre d’action contre l’extrémisme refuse de le reconnaître. Le représentant du Centre a fourni un document signé par des personnes n’ayant jamais apposé leur signature sur ce document. Son avocat a souligné le fait que les noms des deux témoins principaux ont été modifiés et que l’accusation. Il est, par ailleurs, été accusé d’avoir revendu des drogues dans une Université qui n’existe pas à Novossibirsk. La juge Deviataïkina de la cour de Dzerzhinski (Novossibirsk) a choisi la mise en détention de manière abusive.
Nous protestons résolument contre ce procès illégal et les actes du personnel du centre d'action contre l'extrémisme. Nous considérons que l'affaire pénale contre Artem (№ 901380) a été fabriquée de toute pièce. Cela montre l’activité croissante des centres d’action contre l’extrémisme, créés récemment sur la base des organes de la lutte contre les organisations criminelles. Tout porte à croire qu’ils poursuivent des organisations et des collectifs d’opposition et tout simplement critiquant le point de vue officiel. Un faisceau de témoignages montre qu’ils utilisent la torture, la filature et contribuent à la fabrication des dossiers contre des militants, des syndicalistes et des citoyens. De fait, ils prennent une place importante dans le système judiciaire et interviennent illégalement dans la vie civique actuelle en Russie.
Nous considérons que l’affaire d’Artem Loskoutov a un caractère politique et s’inscrit dans la lignée d’autres affaires judiciaires moins connues, concernant la violation systématique des droits de l’homme et de la législation en Fédération de la Russie.
Des dysfonctionnements importants du travail des organes gouvernementaux ont été observés dans des procès liés à la protestation non violente ou à la critique des structures d’Etat. La question posée ici est bien celle des répressions politiques et de l’indépendance de la justice.
Par conséquent, nous exigeons:
Que les procès soient publics. (Sous le prétexte du manque des places, uniquement les journalistes étaient admis à assister à la cour de Loskoutov.)
Que le matériau qui sert de fondement à l’accusation soit rendu public. (Le choix de la détention en tant que mesure de sûreté pour Artem a été fait en appui aux documents du Centre d’action contre l’extrémisme.)
Que soit entrepris un contrôle d’envergure des actions du Centre d’action contre l’extrémisme. (Artem Loskoutov a été arrêté par les membres du personnel du Centre d’action contre l’extrémisme, capitaine de la police Lazarev A.V. et lieutenant de la police Bornikov A.V., tandis que selon l’information donnée par le directeur du Centre aux Mass Médias, “l’arrestation a été effectuée dans le cadre d’un contrôle ordinaire de la circulation extralégale des drogues”.)

Colectarea de semnături în apărarea Artem Loskutov
Anunţăm comunitaţii artistice internaţionale următoarele: artistul contemporan din Novosibirsk (Rusia), Artiom Loskutov, student şi operator, organizator a numeroase expoziţii şi festivaluri de artă video (inlcluisiv, festivalul “Kinovari” (Cinabru), dedicat oraşului Novosibirsk), se află în acest moment sub arest. Acestuia i se incriminează deţinerea ilegală de stupefiante, precum şi crearea unei “grupări criminale”, ale cărei membri au fost declaraţi ca atare de către organele de miliţie, prin Centrul de combatere a extremismului din Novosbirsk, toţi acei cetăţeni care au întreţinut fie şi convorbiri telefonice (!) cu Artiom.
În ziua de 15 mai Artiom a fost reţinut de către miliţie ca răspuns la nedorinţa acestuia de a se prezenta de urgenţă la Centrul de Combatere a Extremismului, cunoscut ca Centrul “E”. El a fost invitat la o “discuţie” (invitaţie telefonică pusă în practică de şeful acestei organizaţii, în aceeaşi dimineaţă). Artiom a refuzat această “discuţie”, motivându-o prin programul său foarte încărcat la locul de muncă, după care apelantul a recurs la o serie de ameninţări la adresa lui Loskutov (mai exact, că va “trimite la locul de muncă o maşină cu un dulău”).
În seara aceleeaşi zile, în timpul arestului, acestuia i s-a strecurat o cantitate de marihuana (11 grame). Despre acestă schemă a miliţiei mărturiseşte un martor ocular, dar şi întreaga procedură defectuoasă a arestării şi perchiziţiei. Indirect, în favoarea acestei convingeri vorbeşte şi faptul că niciun om cu scaun la cap nu ar purta asupra sa marihuana, mai ales în perspectiva întâlnirii cu forţele de miliţie, chiar dacă acesta ar fi un consumator de aşa ceva. Neprezentarea la “discuţie” nu este o crimă, nici un act de nesupunere (în justiţie termenul “discuţie” nici nu există). Nu e o răsplată ilegală şi prea dură pentru nedorinţa de a se prezenta la o “conversaţie”?
Rezultatul: Judecătoria Dzerjinsky a emis un mandat de arestare, fără să se ia în consideraţie caracteristicile pozitive ale lui Artiom; numeroasele sale distincţii şi diplome, acordate pentru merite academice şi culturale; recomandările date de oameni de cultură; adeverinţele că Loskutov munceşte şi studiază. Fiind în stadiul elaborării lucrării de diplomă, e greu de presuspus că acesta s-ar fi ascuns de convocările la proces. Totuşi, judecătoarea Elena Devjataikina a decis deţinerea în arest a inculpatului. Toate faptele invocate mai sus nu justifică această măsură dură şi neîntemeiată.
Susţinerea tezei de licenţă este pusă sub semnul întrebării, ca şi absolvirea cu bine a instituţiei de învăţământ superior, ca să nu mai punem la socoteală compromiterea bunei reputaţii a lui Artiom, precum şi perspectiva de a suporta consecinţele unei condamnări pentru infracţiuni pe care acesta nu le-a săvârşit.
Artiom este notoriu prin activităţile sale culturale, e un talentat artist, precum şi iniţiatorul festivalului de film din Novosibirsk. Ne exprimăm protestul faţă de procedurile inumane la care e supus Artiom, împotriva acţinilor ilegale ale Centrului de combatere a extremismului. Considerăm că procesul penal intentat împotriva lui Artiom Loskutov (Dosar nr. 901380) este o cacealma. Atragem atenţia că prin aceasta se crează un foarte perculos precedent, care poate submina drepturile cetăţeneşti în oraşul Novosibirsk, şi chiar în afara acestuia; un astfel de precedent va putea face victimă pe orice cetăţean. Cu atât mai regretabil este că acest incident se întâmplă exact în Anul Tineretului.
Rugăm organele abilitate să analizele faptele, şi să ia măsurile necesare pentru grabnica eliberare de sub arest a talentatului artist şi activist cultural Artiom Loskutov.
Acestei petiţii se anexează lista de semnături ale celor care-l susţin.
Există toate temeiurile pentru a presupune că procesul lui A.A. Loscutov are un caracter politic, şi se află într-un şir larg de alte procese mai puţin cunoscute, desfăşurarea cărora e însoţită de încălcarea sistematică a drepturilor omului şi a legislaţiei Federaţiei Ruse.
Încălcările flagrante în activitatea organelor de stat au loc sistematic anume în procesele legate de protestele paşnice sau de nemulţumirea faţă de activitatea organelor de stat, fapt ce ne permite să vorbim de represalii politice, ce au loc la momentul de faţă în Rusia.
În legătură cu acestea noi cerem următoarele lucruri:
Toate procesele de judecată trebuie să se desfăşoare în mod deschis. (La audierea procesului lui Loscutov au fost lăsaţi să intre doar jurnaliştii, pe motiv că nu sunt de ajuns locuri.)
La judecată trebuie să fie prezentate toate materialele, în baza cărora se construieşte acuzarea. (Argumentul de bază prin care s-a hotărât măsura represivă, în formă de arest, au fost materialele neexpuse a Centrului de combatere a extremismului.)
Efectuarea unui control de proporţii mari cu scopul evidenţierii depăşirii atribuţiilor Centrului de combatere a extremismului (A. Loscutov a fost reţinut de colaboratorii Centrului de combatere a extremismului, de căpitanul Lazarev A.V. şi locotenentul de miliţie Bornicova A.V. Însă, în declaraţia pentru Mass-media, V. Peşnev, şeful Centrului de combatere a extremismului, a indicat, că “reţinerea a fost efectuată în cadrul raidului ordinar pentru combaterea circulaţiei ilegale a drogurilor”.)
